I. BUSINESS TERMS of Schmuckperlen.com

All items are wholesale priced unless otherwise indicated. No minimum order is required and your wholesale license does NOT need to be on file with Schmuckperlen to purchase wholesale, however for orders under 40€ in value we charge a 5€ incl. VAT (4,20€ excl. VAT) low order fee to cover our administrative cost. VAT/Sales Tax is included in our prices and will be added to the invoice, if shipment of your order is to an address in the European Economic Union.

Please don't send us faxes or e-mails requesting to send you a catalog. You are seeing the only catalog we have: our website. We much prefer e-mail communications to fax, as we are an Internet business.

You need not contact us prior to placing an order. It is possible to place an order immediately. If you feel something has gone wrong with your order or the pricing of an item, complete the order online which will send it to us electronically and add a comment with your concerns, and we will contact you prior to dispatching your order. Don't fax your order to us, if at all possible.

All shipments are shipped from Alsfeld, Germany unless specifically agreed to otherwise.

Manual Orders:
All phoned, faxed and e-mailed orders incur a 5.00 euro handling charge. Orders on our secure servers are convenient, easy, accurate, up-to-date and absolutely safe. You don't need to leave your credit card number on-line to place an on-line order. You can fax the credit card number to any of the above fax numbers or leave it on our answering machines. If you prefer not to leave your credit card on-line, select the first shopping cart screen (under the ordering instructions box) either the option "I will call with my credit card number" or "Credit card on file with Schmuckperlen". This way you won't incur the 5.00 euro handling fee.

Invoices:
We are unable to issue invoices for value other than that of the merchandise. We can mail the invoice separately from the shipment and, if desired, to a different address. We can declare the beads on the customs slip as "Glass beads," "Craft supplies," "Beads," "Artist Materials" and similar. If you have a preference, please annotate in the comment box when ordering. This information is not necessary if your ship to country is located in the European Union.

Shipments:
While we make every attempt to ship within 24 hours, orders are normally shipped within three (3) business days after receipt of order at Schmuckperlen.com. Once orders have entered the picking cycle orders can no longer be cancelled.

Delays may occur if your address is incomplete (especially on phone or fax orders), your e-mail address invalid or your credit card payment does not clear. FEDEX and UPS cannot deliver to a Post Office box and require a valid phone number. Delays and additional cost can incur if incorrect address information is received. These cost are to be bourne by the customer. PayPal payments paid via eCheck take up to ten days to clear and will ship after the eCheck has cleared. Allow 1 week during a major show. Custom work requests may require an additional 3-7 business days. Please note that Venetian beads are always in short supply - they are handmade.

To avoid disappointments please watch out for the "Insufficient Stock" notice next to an item in the shopping cart. This means that we don't have the quantity on hand to fill your order. As a service to you we'll normally confirm if you intended to backorder or if you would prefer a substitution. If you are aware of the backorder situation, as short comment to that effect will avoid delays. If you've saved your shopping cart for a while, items which were in stock when you saved the shopping cart, may no longer be in stock when you place the order.


II. PURCHASE PAYMENT TERMS

Prepaid:
All orders must be prepaid unless specified by a Schmuckperlen account representative. While we customarily charge your credit card two days prior to shipping, on occasion you may be charged up to 10 business days prior to shipment. Orders are subject to acceptance and credit review by Schmuckperlen.

Credit Cards:
We accept Visa, MasterCard, and American Express. We reserve the right to request additional information, such as CVV (Credit card verification value--the 3 digit number on the back of the card) and photocopies of your credit card (front and back) for orders which fall into certain categories. Categories where we can request this information: differing :"Bill to:" and "Ship to:" addresses, Swarovski crystal beads orders and others.

Debit Cards:
We accept VISA and MC debit cards as well as credit cards. For our UK customers: we welcome all SWIFT cards. However some SWIFT cards do not work on our credit card processing equipment, mainly cards starting with "6". We are sorry for any inconvenience caused. We do not accept EuroCheck credit cards via Internet.

Checks:
We DO NOT accept checks.

Wire Transfers / No Credit Card?
We accept wire transfers at no additional charge. Wire transfers take on average 3working days to reach us thus your order will take that much longer. To arrive at the correct total for your wire transfer, please ensure that you have selected your VAT of 16% (if the order is to be shipped within the EU) and that you have chosen your desired shipping method in your shopping cart.

Please use an International Wire transfer or a Überweisung. Starting on 1 July 2003 International Wire Transfers within the EU are charged the same rate as a national bank transfer. For International Wiretransfers, please use the following bank information and instruct your bank that you will pay the wire fees (applies only if you are outside the EU) and that all wire transfers must be in Euros. We will not assume your wire transfer fees or currency conversion fees. Third country wire transfer fees are not necessary and to be avoided. Please advise your bank accordingly. Shipping Cost And Policy:
Shipping cost are not on an exact cost basis, however includes postage and handling fees. Whenever possible we will combine separate shipments to save in shipping fees. Equally we may divide a shipment to lower postage on the order. Please expect your package 7-10 business days (yours and ours) after placing the order. We will notify you by e-mail if we encounter delays, equally you may check on our order status system the status of your order at any time. Shipping your order to you comprises of us picking the beads, assembling the order, communicating with you and shipping the merchandise out. Shipping fees cannot be refunded for that reason.

Order Status and Tracking Info:
You can track your order status by logging into your account and checking on the status. Your package can be tracked (however limited) at the Deutsche Post Web site. Or by clicking on the tracking link for FEDEX and UPS shipments we provide you via email.

Expedited US packages can be tracked with the US Post Office at Track and Confirm: www.usps.com/shipping/trackandconfirm.htm within hours after posting the packages. Many other countries post offices offer the same service, please check your country´s postal website.

Claims and Shipments Damaged in Transit, Damaged Merchandise

All claims must be reported within three (3) days of receipt of the shipment. It is the customer's responsibility to correspond with FEDEX and UPS and file the claim. Pictures as proof of damage either from a scanner, copier or digital camera are required. In case of loss or damage, please file a claim with the carrier immediately upon receipt of damaged merchandise or suspected loss of shipment. When contacting us, please state the SKU number and order number and forward the digital proof of damage. Don't send anything back until we have asked you to do so and if you send something back follow our return instructions. The customer's failure to follow the instructions above or failure to file the complete claim within the time period alloted may result in the claim not being adjucated. It is our standard policy to replace broken merchandise and not issue credit. It is at our discretion to require merchandise to be returned or to accept scanned or digital pictures as proof.

Lost Shipments:
Suspected lost FEDEX and or UPS shipments need to be reported within 2 days of the expected arrival date by email or fax to Schmuckperlen.com. Lost postal shipments need to be reported within a week of the expected arrival date. Notices about lost shipments are to be sent by email to perlen@Schmuckperlen.com or by fax. You are provided a tracking link via e-mail or can access tracking information through our order status page for this purpose. The customers failure to timely report lost shipments or assist with the recovery of the shipment will lead to denial of any resulting claims. The customer is responsible for correct address information.

Special Orders
Special orders placed for quantities in excess of stock levels maintained by Schmuckperlen.com - Schmuckperlen G2B GmbH are binding orders and subject to a restocking fee of 20% if cancellation information is received less than 45 days in advance of anticipated and agreed to shipping date. Once shipped the order cannot be cancelled. A variation of the shipping date up to 45 days is possible and is not reason for cancellation of a special order. Special orders can only be returned if the merchandise delivered is substantive defective, ie the beads or merchandise is broken or cracked. We accept special orders only in writing. We require payment either by credit card, Direct Debit or wire transfer at the time of placing the order. The customer specifically waives his/her right to refuse and/or dispute or reverse the charges.



Sales Tax And VAT License (Other than EU):
We do not need your Sales Tax License on file with Schmuckperlen prior to you placing an order. We appreciate you providing us with your number in the comment box of your first order.

European Union Orders Only:
We are primarily a wholesale supplier. All our prices are ex VAT. For that reason, all EU orders will be charged 16% VAT, unless your orders are over 1000 euro and you do have a VAT license on file with us. If we incur a backcharge from German Customsoffice due to incorrect VAT number or expired VAT license, we reserve the right to charge your account accordingly.

U.S. Customs And Import Duties:
Our loose unstrung glass beads are free of U.S. import duties or customs, under HTS 70181011 in the International Tariff database, and are made in Italy. Freshwater pearls are produced in China and are free of customs and duty in accordance with HTS 710121. If you are in the U.S. and are asked to pay customs do NOT pay customs duties, but contact us immediately. We will fax you documentation which will clear up the situation as the beads and pearls are free of US customs duties.

Countries other than U.S., please check your country's custom regulations to find the most advantageous customs category for you. We can declare the beads on the customs slip as "Glass beads," "Craft supplies," "Beads," "Artist Materials" and similar. If you have a preference, please annotate in the comment box when ordering. This information is not necessary if your ship to country is located in the European Union.

Backorders (and items out of stock):

As a service to you we'll normally confirm if you intended to backorder or if you would prefer a substitution. If you've saved your shopping cart for a while, items which were in stock when you saved the shopping cart, may no longer be in stock when you place the order.

All items not shipped are automatically backordered, unless otherwise instructed. This is meant as a service. If you prefer for us not to track backorders, please so state in the comment box when placing the order. Backorders below 30,00 euro will be charged 5,95 euro s&h, unless you add an item at the time we contact you that we have received stock to fill the backorder. We will contact you 3 days prior to shipping out a backorder. The backorder will ship unless we hear from you or you asked us not to track backorders.


III. MERCHANDISE INFORMATION

Prices:
Price changes become effective immediately and without prior notice. Please expect changes in prices and shipping charges around the first of the year.

Volume Discounts:
High volume sales will be given a quantity discount:
orders over 500 euro (to see how much this is your currency click here) receive 5% discount,
orders over 1000 euro (to see how much this is your currency click here) receive 10% discount,
orders over 2000 euro (to see how much this is your currency click here) receive 15% discount,
orders over 5000 euro (to see how much this is your currency click here) receive 17.5% discount and
orders over 7500 euro (to see how much this is your currency click here) receive 20% discount.

Design Variations:
Most items are handmade. Designs may vary.

Sizes And Color:
Due to the nature of pearls and Venetian beads, sizes and color may vary slightly. Due to the nature of handmade products, sizes and color may vary slightly. All Venetian beads, however, especially baby heart beads and millefiori, show handmade irregularities - these are considered a sign of handmade quality and are not reason for a refund. It is normal for some of the goldfoil to be on the outside of the beads, especially for baby heart beads - this is not a defect. If more than the normal irregularities are encountered in a batch of beads, we will include extra beads at no additional charge. Millefiori beads are not high quality beads, as you can see by the price. Please don't compare their quality to the quality of the gold and silver foil beads.

Custom Work and Matted Beads:
Custom work and matted beads cannot be returned or exchanged. Custom work can be adjusted but will be charged extra.

Promotions:
All show sales are considered final unless other arrangements are made at the time of purchase. Regular promotions and purchase incentives are not always announced. Ask your sales representative for any promo updates.

Shipping Dates for Christmas:
You can order to two days before Chrismas (in 2005 Wednesday 21 December) before 2:00 pm German time or 1:00 pm GMT and ship via Fedex to the US for US$16.95/ 14 Euros (including Hawaii and Puerto Rico) and your order will be with you before Christmas. You can use UPS Express shipping and the order will be in most US cities the next moring before 10 AM.

Registered Mail usally takes 2 weeks to reach the customer and, for that reason we stop using Registered Mail service for shipments outside of Europe on 6 December. Expedited Mail takes about one week to reach customers outside of the EU and for that reason we don't recommend it after 15 December.

Our policy is to ship the same day the order gets in, whenever possible (this applies specially during the Christmas season) provided that we receive your order prior 8:00 am German time (or 7:00 am GMT). We will make every attempt to ship out orders, which are received later, however cannot guarantee it. This also means that we should have received your payment :-), credit card is best as it is fastest and will insure your shipment leaving.

V. PRIVACY STATEMENT

Schmuckperlen is committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the European Data Protection laws). We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

We will not e-mail you in the future unless you have given us your consent.

The type of information we will collect about you includes:

  • your name
  • address
  • phone number
  • email address
  • credit/debit card details

We will never collect sensitive information about you without your explicit consent.

The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

The personal information which we hold will be held securely in accordance with our internal security policy and the law.

If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

Your statutory rights are not affected.

Return Policy:
Returns must be made within 10 days of the date of receipt, in the same condition as sold; i.e. (in original packages, no partial strands etc.). A copy of the invoice and a clear explanation concerning the nature of the return must accompany the returned merchandise. We reserve the right to charge a restocking fee on all merchandise returned after 10 days. Special orders or items made to your specifications are not returnable. We matte beads to specifications. For that reason, matted beads are not returnable. Also excluded are magazines--they cannot be returned. All merchandise is checked for perfection prior to being shipped.

Return of jewelry needs to be made with in 3 days of receipt, all other conditions as above. Earrings may not be returned for hygenical reasons.

We charge a 15% restocking fee for return of Swarovski crystals, as these are standardized and never vary, all other conditions as above.

Returned merchandise needs to be clearly marked on the customs slip as "Return of German merchandise, Unstrung glass beads (pearls) Country of Origin EU, Italy (China)". Customs and excise fees levied on us for failure to do so will be charged back to you - the charges are customarily 16% of the value plus a handling charge of ~ 25.50 euro- 37.40 euro. Correctly marked packages incur no charge, and are not expensive to return (also see below).

To return beads from the U.S. you should use First Class or Priority Mail. Do not use Global Priority Mail. The cost should no be more than $4.00 euro. Contact us prior to mailing should costs exceed $4.00.

If you received damaged beads, they were damaged in transit. This can happen despite good packaging, as our merchandise is fragile and mostly made from glass. Here are some Frequently Asked Questions (FAQs) about Returns:

What are the conditions to return jewelry?
We only accept return of jewelry that is in its original condition and packaging, unworn. Earrings may not be returned for hygenical reasons. Return of jewelry needs to be made with in 3 days of receipt, all other conditions as above. Special orders may not be returned.

How do I return merchandise?

How easy is it to return beads?
It is very easy. All you need to do is include a copy of the original invoice, and have the beads in their original bags with the correct sticker still attached. Regular AirMail shipping is fine and costs on average about US$4.00 - US$6.00 from the United States. On the outside of the package please affix a small green customs sticker CN22, which states "Return of German Merchandise, Unstrung glass beads TARIC-Code 70181051". Please don't forget the copy of the original invoice. That's all there is to it.
